Giles, 47, was walking onto a covered display area at a ear dealership when she slipped on accumulated ice on the deck and fell. Giles suffered a fractured shoulder, incurring medical expenses of about $34,800. She is expected to need shoulder replacement surgery in the future. Her future medical expenses are estimated at between $65,000 and $69,000.
An assistant shift manager at a hotel/casino earning about $41,500 annually, Giles's past lost income was approximately $28,200. She will miss four to six months from work in the event of surgery. Her future lost income is estimated at $15,300.
Giles sued the car dealership, alleging negligence in allowing a dangerous condition to exist on its premises, failure to inspect, and failure to warn.
